Sixth and seventh inmates claim jail abuse

TAMPA -- A former special-education teacher says Hillsborough jail deputies violently threw him to the floor of a cell, put a hood over his head while he was in a restraint chair, and intentionally obstructed the view of a surveillance camera before beating him.
And the attorney representing him also brought forth another new client at a news conference this afternoon, a man who uses a wheelchair who says Hillsborough deputies forced him to ride on the floor of a van for more than three hours, aggravating his spinal injuries. They are the sixth and seventh claims of abuse by Hillsborough jail deputies to publicly surface this month.
Records show Paul King, 40, was arrested five times in Hillsborough County between May and July of 2007. The charges ranged from DUI to reckless driving to domestic assault. On July 7, he was booked on charges of disorderly intoxication and battery on a facility employee by expelling fluids. His attorney, John Trevena, says he has video showing the deputies mistreating King that day.
A Sheriff's Office spokesman could not be reached for comment on the latest allegations.
Video shows a deputy hurling King to the floor. It shows him seated in a restraint chair with a hood over his head. It also shows a deputy relocating paper from the glass cell wall in a way that blocked the camera's view of King's head.
"The one element of it that's going to be completely indefensible is when he's taken from the glass and thrown forcibly," said Trevena, adding that King was not resisting at that time.
At the news conference, King said deputies at the jail "made me say vile things about myself just to humiliate myself, and the other deputies laughed."
State arrest records show King’s life taking a sudden turn last May. His first arrest came May 27, when he was cited with reckless driving and DUI. Two days later, he was arrested on a charge of burglary of an occupied building.
July 4, he was arrested on suspicion of driving with a canceled, suspended or revoked license and DUI. He was released on bail or his own recognizance.
Three days later it was battery on a facility employee and disorderly intoxication for which he received three years of probation. King alleges the abuse took place after this arrest.
Eight days later on July 15, Temple Terrace police arrested him on charges of suspicion of battery of someone over the age of 65, battery on a facility employee, disorderly intoxication, DUI, reckless driving and trespassing.
In December, the Hillsborough County Sheriff’s Office arrested him on suspicion of battery assault. He was not prosecuted.
Even though Hillsborough Sheriff David Gee has already asked a citizen panel to look into his agency's detention practices, Trevena called that "window dressing" and urged appointment of a special prosecutor to look at the abuse claims. "The floodgates, so to speak, have opened," Trevena said.
At the news conference, Trevena's associate introduced client Nick Joseph Molfetto, who had to be transported from the Lake Butler Correctional Institution to the Orient Road Jail for a court date and says Hillsborough deputies forced him to ride on the floor of a van despite his telling them he needed a special van for the disabled because of a spinal surgery.
Molfetto has been arrested about 21 times in Florida, state records show, on charges ranging from larceny, battery, burglary, weapon possession, cocaine possession, dealing in stolen property, aggravated assault on a law enforcement officer and fleeing and eluding.
Jail officials made headlines repeatedly in recent weeks when former inmates came forward with abuse claims.
The most famous case involved Brian Sterner, the quadriplegic whose ejection from his wheelchair at the hands of Deputy Charlette Marshall-Jones was seen on video around the world. The incident led to Marshall-Jones' arrest on a felony abuse charge.
Another inmate said a deputy had broken her arm. And two more inmates claimed to have been beaten or abused, one saying she suffered brain damage. Then, on Thursday, the Sheriff's Office released footage in the case of Benjamin Rayburn; the combative paraplegic was left on the floor of a holding cell for 62 minutes after deputies took away his wheelchair.
"I'm beginning to think now that this may be a class action," Trevena said.

I'm beginning to think that this lawyer is seeing an early retirement!! Come on, I can totally see the first case, but these others are just rediculous!! Let's see... if they weren't criminals, they wouldn't be there to recieve what was coming to them. What if we had an eye for an eye law system? They should be thanking their lucky stars we don't and that's all they got for their behavior...!

Yeah, they were arrested. Presumably did something wrong. But the jail staff are supposed to be professionals. If someone gives you a hard time, call for reinforcements to assist. No need to go "Rodney King" on anybody.

All this new technology; video, web cam, spy satellites, are catching ALL the criminals wherever they are. Blocking the visual of a camera is enough of an admission of guilt. This kind of stuff has been going on for years in the secrecy of off camera. Whats good for the goose, should be good for the CO's too. Just ask Ms. Jones and all her accompanying onlookers! One can only imagine all she may have got away with in those past 22 years before she got caught. Not too many whistle blowers in those circles. One cannot be a snitch, got to play along to get along. What a can of worms, methinks.

Its JAIL, not a country club. Last time I checked, you get umbrellas in your drinks and foot massages. I encourage anyone whos never spent time at one to go visit for an hour and get to know the scumbags that get brought in.
They are NOT the peaceful-protesting hippies that were getting harassed by the cops in the 60's; theyre crack dealers, child molesters and violent offenders, and theyre all too willing to tell you how the whole world is against them.
Theres got to be some degree of deterrent to breaking the law AGAIN, and getting sent back AGAIN. Let the cops do their jobs.

Since when do criminals become saints? They would not be in jail if they were. I am so tired of hearing how criminals are mistreated and the minority screaming discrimination just to put dollars in their pockets, to make easy money instead of working their butts off like most average Americans. Get a real honest job here in Florida with low wages, work and learn how to be straight, that goes for those in law as well.

I agree with al. If he stops drinking, he won't be visiting the Orient Hilton anymore. Period. I believe the abuse is justified, and I think that it should be endorsed by the HCSO. They should NOT run from this. They should admit that it has been and that it is the practice. Don't break the law, and you won't be beaten up by the cops in jail. It's just so simple. These are the dregs of society. These are the muurderers, the raapists, and the drunk drivers. I personally wish they'd just take the people at Orient and dump them in the Gulf of Mexico 50 miles out and if they can swim back, great, and if not, we're all better off. Somewhere down the line we all may have done something we are not proud of but respect is do to a dog. Therefore people should be treated with respect as well. We have children in the system who need help this is not far who knows what go's on behind closed doors. Lord bless and protect our children.

Stop drinking? Wow, those have to be the most ignorant comments I've seen. Apparently some have no clue about addiction, which is amazing in this day and age. The information is out there- oh, wait, this is FL, land of no research and education while spouting off at the mouth (see evolution).
As these incidents are taking place in JAIL, not prison, these people have not been CONVICTED. They are therefore INNOCENT. These are basic facts.
Beating an inmate is NOT a LEGAL way to deter someone from committing a crime. The LEOs have no more right to break the law then those who are found guilty. Who thinks they do? Obviously some who post here.
If they are allowed to break the law and violate rights and policy, where would it stop? You think it stops with you? Think again. If they can BEAT people, why not unlawful search? Why not unlawful arrest? Why bother with Miranda rights?
Hell, why not a police state?
WE'RE supposed to have one of the best justice systems? We're going to criticize how others behave? These are tactics seen in those areas we are supposed to HELP.
Violence begets violence. In no way does beating a person encourage them to not break the law.

I am shocked at the level of ignorant responses from about 1/2 of the people that have responded so far. Regardless of why they are in prison doesn't make it right. The reason juries set so many people free is because of the bad press and the poor display of professionalism of law enforcement officials. If your goal is to make the system better then think about it logically. Most law enforcement officials are from a pool of adverse selection and that's why these issues happen. The officers should be suspended without pay, and charged accordingly by the District Attorneys Office. Unbelievable!!

Man, this is blowing up fast and furious! Hood on his head (used for someone spitting), Strapped to a chair (used for a control problem; either danger to himself or others), Paper over window(used for someone who has soiled thier pants or refuse to put on clothes in which case you do not want the opposite sex exposed/seeing them). I am not going to be naive and say that this did not happen. I will say this, EVERYONE, should be placed under oath. I have very little faith in the cameras, as they do not record sound and they contribute less to a person's motives and actions. Unless, it was mistaken identity for these "so-called victims" why were they placed in confinement in the first place? I believe the objective at Orient Road is to instill a phobia about ones actions, as to reduce crime.

Whatever happened to "...innocent until proven guilty". Most of these individuals are in custody awaiting trial on allegations. Those that have not been convicted are are not "criminals"...yet. Even so, cops and detention deputies are well aware of the Use of Force matrix (continuum of force). Unnecessary use of force and brutality are actually criminal acts and should be prosecuted accordingly. In fact, cops who witness other cops (or correctional officers) abuse prisoners may and should arrest the offending officers on the spot! Wouldn't that be refreshing and commendable!

Did the paper cover the WHOLE glass? Or just some? Are the female deputies going to be offended? We are talking adults, are we not?
So he spits. Is he somehow infectious? Isn't it likely his mouth would dry out before they could get a hood on him? What of we're talking spittle as he speaks? Isn't it easier to back away?
A danger to himself or others? Wouldn't that be grounds for a Baker Act? Aren't cuffs going to help that?
To deescalate the situation one has to not anger the person more, but to calm them. What's the purpose here? It's not to deescalate.
I don't think sound matters in these cases. A verbal threat is nothing if the person cannot act on it. A verbal threat on the street to another won't get police involvement. Anything verbal does not excuse or demand violence unless one is losing their temper or trying to reinforce their personal control over another. It is not the control the deputies have over the inmate that matters, it is the overall control of the situation. That's the problem here; this is supposed to be professional, not personal. When it violence is introduced, it is personal.

If the guards have PTSD they should be out the front door just like in the military. PTSD is not an excuse or justification for their behavior. This behavior brings discredit upon themselves, their department and confuses the law abiding men and women in uniform.

You are actually leaving out the most important word "PRESUMED". Also the whole presumed innocent until proven guilty applies to the court, not the jail. If the jail presumed them innocent, they would just let them out of jail.

I've been in and out of prison my whole life. I'm 60 years old, and a two decades of it I spent in various prisons. I've done time in Florida, Georgia, South Carolina, and even a small stretch in Delaware. This prisoner abuse is ubiquitous. Florida's bad, but it is no more pernicious than in other parts of the country. I'm delighted that the problem is surfacing, and hopefully it will be redressed sooner rather than later. And I have something of a vested interest, because if the past is at all a predictor of the future, I'll be residing in such a place yet again.

Assuming that you are referring to my statements. The hood, chair and window closures are accepted methods for Correction Professionals as stipulated in the American Correctional Association Governance. In other words ANY Correctional institution in the United States that is Certified to house inmates at any level is REQUIRED to adhere to these standards or they lose Accredation meaning the likelihood of them being able to incarcerate anyone would make an even bigger mess for correctional facilities. Look, as a taxpayer I am not proud of these alledged allegations, but lets face it, it is more questions than answers.

If these are the *accepted* and *required* practices found in law enforcement, then the idea that these are "correctional" facilities is an absolute joke. All these practices do are reinforce what behaviors possibly brought the accused into the system in the first place; violence, intimidation, and the humiliation of others to gain control.
The term "correctional" implies that the goal is to correct the behaviors and in turn lower recidivism. Clearly, it's quite the misnomer.

Many, when released are not corrected in the sense of knowing right from wrong but released physically and or mentally damaged and in no condition to join society. Their conditions/situations have been pushed off to the taxpayer and other institutions of rehabilitation. I would like to see justice imposed on those border line sociopaths that "snuck into uniform" and that have purposely, physically and or mentally abused their clients in need of reasonable correction.

I am sure some inmates are just foaming mad and have to be somewhat manhandled to keep some semblance of order, but all too often, it would appear that those in charge might go beyond the call of duty, just a little bit, toward the torment category, and like it? Upending paraplegics on the pavement, leaving them flop around like some fish out of water is no ones idea of a good time. But this is perhaps minor, seeing that the offender(s) had no qualms about doing it on candid camera. But behind closed doors and off camera is where the real fun begins. Can you say 'cruel and unusual', oh that's right, inmates don't have rights.

I'm not sure that I believe anyone "deserves" to be treated badly behind bars (County or otherwise). If a situation calls for strong physical action, say on a drunk or junkie, it has to be done. But abuse in the Jail system is out of control, has been for some time, and these more than likely by some rookie CO's, or someone cursing themselves by taking such a job to begin with..who knows.. but overzealous COs, and the people who oversee them, ie Sheriff, need to rethink their entire protocol and effect a humane way of dealing with the waywards of this society..that should not include beating and abuse.

There are people in jails/prisons that HAVE been convicted and later to be found innocent!

The detention officers dont have to be lookin for trouble they work in the jail. the people that get roughed up in jail started it and officers don't need to take their crap. when you work in places like the rest of us we dont have to deal with the scum of the earth day in and day out. If I worked in the jail I would have been convicted and forgotten about long ago for tearin one of these little dirt bags apart.

Others DO deal with the same people and those who act out and they don't have to resort to violence and humiliation to deal with the situation.
We're talking JAIL. We're talking many who have not been tried in a court of law, but apparently the justice system means squat to many who post here.

Except for Sterner, all these other instances are most likely JUSTIFIED!!!!! Get off your high horses and realize these people are mostly dirtbags. They didnt get in jail for selling the most girlscout cookies.

Can we get rid of police completely and just have vigilantes? I mean, screw the justice system, it's too brutal. Just hang people we "think" are guilty. Well hey, that cuts out the middleman and we'll save big bucks!
These cops are dirtbags, those arrested are innocent. Let them all free! Let them free, let them free, let them free!
Proclaim all in jail to be innocent so that our country won't have to pay these people to treat every sweet innocent human as if they have committed a crime. No innocent man would resist authority, but authority forces them to resist! They practice a form of Jedi mind control.
Kinda like the girls who think they are too pretty to fly. Everyone thinks they're above the law and above other humans.

Ok, BB, you're better therefore you get to act out. I see. Others are better than the people there so it's ok if they are humilated and brutilized outside the scope they are allowed.
Sure some are more than likely justified, there are those who will look for payout. But the fact that they are in jail - not always convicted, UNDERSTAND? - does not mean they are "dirtbags" or "scum". Even if they are, it does not mean that others have the right to harm them in anger.
It means that the police are on the SAME level as the "scum" though. Not who I want carrying a gun. How can they enforce the law if they can't abide by it?

Horrid! Anyone see the video of the most recent guy? In it he is slammed to the floor and decorated with a hood? Kind of reminded me of the scene in Pulp Fiction where Spider catches a couple of flies and has his way. Looks like them guards were trying to turn their prisoner into the Gimp.
