Second Scientology suit rejected

CLEARWATER -- Circuit Judge Douglas Baird today denied a motion for a temporary injunction sought by the Church of Scientology to prevent protesters from getting within 500 feet of Scientology buildings.

A group of protesters calling itself Anonymous plans demonstrations against Scientology Friday and Saturday, coinciding with the church's birthday celebration of its founder, L.Ron Hubbard.

This is the second of two similar suits filed by the Church of Scientology this week. The first was rejected by Circuit Judge Linda Allan on Wednesday.

"This court is mindful of the anxiety that may be caused by anonymous threats of violence, or as a series of seemingly unconnected incidents, be they on the internet or otherwise,'' Baird wrote. "However, the jurisdiction of the court must only be exercised to specifically restrain those known individuals that are shown to have some reasonable nexus to the actual threats complained of in the petition.

"Here, as alleged in the petition, there appears to be a number of individuals who more or less refer to their cause as "Anonymous,'' but there is no allegation of the existence of any organization or hierarchy of command that exercises any form of collective or coordinated action that results in the systematic deprivation of the petitioner’s rights."

My concern remains about the sudden invitation for families with children to attend events that day in the general area, despite the CoS's public accusations that Anonymous is dangerous and violent. Oh Rhonda. Your playbook is getting a little thin, isn't it? Let's just break down your argument, piece by misguided piece.

1. You're attempting to equate the protesters of Anonymous with an organization such as the KKK to elicit fears of hatred and bigotry - and that is clearly not true. There have been no incidents of violence, no intimidation, or even any threat of harm. But it is clear that the disguises pose a threat to your attempts to document and attack the protesters as individuals.

2. You've secondly made the indirect correlation of "Arabs in disguize" (grammatical errors included). Besides being overtly racist, you are again attempting to invoke some sort of fear of the protesters by insinuating that they are out to do harm, or that either entity is associated with terrorism. You insult the Arab people, its culture, and show your true bigotry.

3. You mentioned the WTO protesters wearing masks. But what you neglected to say was that they were gas masks, in response to threats of the use of tear gas (which was used). By implying that they were hiding their identity to avoid prosecution is also incorrect, and of course, a fear mongering tactic.

4. You capitalized the Police as if they were a proper noun, not a pronoun for an organization. I assume you mean that at some point, Sting and the rest of the band will be making an impromptu performance to support the protesters. I approve. Maybe they'll play "Wrapped Around Your Finger" for you?

5. You used the term "By any means" to invoke the ideology and association of Malcom X and his afro-centric movement during the 60's. While this is not as bad of an association as you may think, it does imply violence in an organization that has historically avoided such things, or statements. You are attempting to put words, or imagery into play that does not carry the same association.

6. You pray for peace with the protesters. I'm sure they appreciate it. I believe many people also pray for their safety. But to whom, or what, do you pray to? As far as I know, Scientology is not an organization based upon deism. I would be careful, because if your managers find out that you have been endorsing monotheism, you could be in a great deal of trouble.

7. You invoke PTSD as a way of marginalizing the mindsets of the protesters, either to imply that they are not in control of their own mental state, or that they are somehow victims of some organization that imprisons, brainwashes, and tortures people. I know you don't believe in this, but in psychological terms, this is called "reflection", or projecting your own problems upon others as a form of coping with a traumatic experience. I hope that one day you break free from your captors, and are able to exercise your first amendment rights in an equally peaceful manner as the ones you will see on the 15th. Watch them very carefully, because one day, you too can have the opportunity to express yourself without Scientology directing your every action.

The Scientologists commenting on this article should read more comments elsewhere. It is so easy to pick you out Rhonda, Reporter, GI. You communicate in this oddly out of synch way, almost as if you have trouble writing English properly without all the scientology neologisms and cant. You also do not address actual objections, but instead attack, attack atttack.

You stand out like sad sore thumbs. Come on, little thumbs- you must know in your heart you are being used and lied to and your dignity as a human person being stripped from you. Give up your cult. Leave it for the real world. Cross the only bridge to freedom- the bridge out of the Cult of Scientology.

I will pray for you that you break free and follow your hearts in the real world where you are loved and missed, where no horrid midget uses and beats and harms you emotionally and physically, where the only CoB that matters has corn on it.

How I wish I could be there on Sat. to support Anon!

I have lived most of my life in Pinellas County and grew up in Clw. I remember when they "saved" the Ft. Harrison Hotel and we were all scared to walk in downtown Clw. at night because they stalked everyone there.

Since then, I have steadily watched them take over downtown! I cringe when I hear comments like "they saved downtown" or "without them it would be a ghost town"! Replacing 1/3 of the "church" buildings with tax paying tenants would bring thousands if not hundred of thousands of dollars back into the city.

Quite honestly, I don't concern myself with what the church itself does. I know that is ignorant and selfish, but I believe people make their own choices. (the children from other countries is another story, however) My bigger concern is the amount of money that has been stolen from the City of Clearwater all of these years.

Do you people not realize why many of the lower income programs keep disappearing? Do you really know the strains that the police and fire departments feel? Tax free for most of downtown means no money for the citizens. Wake up Clearwater and realize what this is doing to your economy!

The cult that is Scientology is collapsing. Their hand picked and groomed celebrities are showing signs of mental instability. Their grasp on the city of Clearwater is slipping.

Documents are appearing proving the "church" has attempted to control the elections in Clearwater which could very well lead to the revoking of their tax exempt status.

The evils that this cult has committed are becoming common knowledge. We know that you've illegally harassed, stalked, blackmailed, and murdered.

You're on borrowed time and while Anonymous is not a group, but merely a title given to individuals who wish to keep their identities private, these individuals have greatly helped in bringing your deception to the masses.

One of the girls named in the injunction was simply a spectator, who just happened to sitting at starbucks on the 10th feb...just minding her own business. Some guy about her age cosied up to her, chatting about scientology and acted like he was against it. She didn't have any connection to anonymous or the protest. Next thing ya know, I see him the next day at starbucks in a yellow scientology volunteer tshirt.
He must have gotten her name and 'reported' her even though she wasn't anonymous and didn't have a thing to do with it. The paper interviewed her and she was real upset at scientology accusing her of criminal acts when she was only sitting having coffee and an opinion.

the Co$ is clearly desperate and (given their stated means of dealing with ANYTHING they see as 'opposition') I'm concerned with what they might try next:
~ pose as Anon protestors & cause trouble
~ do damage to their own property
~ (God forbid) do harm to their own people
in their perverted view, they might see this as a means to garner sympathy, portray the Co$ as a victim in the popular media, increase contributions and lay grounds for possible future injuctions

All it takes for evil to succeed is for good people to do nothing. The actions of these judges, the danger they put themselves in by their choice, show the type of people they are. If only there were more like them, then the CoS's endangerment of lives would have been stopped long ago.

These brave judges have made a very wise choice in denying the requests of scientology.
To Anon and anyone else who seeks the death of the 'church'... don't buckle, don't back down. Ever. Stand up to them as hard as they will have other people stand up to you. There are not nearly as many scientologists as they say, and all it will take is a little shake, and the 'church' will crumble like a pillar of salt.
