Bob Allen's bathroom hideout
On the eve of Rep. Bob Allen's day in court on solicitation charges, documents released Wednesday provide a deeper take on what happened at the Titusville park. According to an affidavit from assistant police chief John Lau, who visited Allen in a holding cell, Allen said he went into the park restroom a second time because he did not want to get struck by lightning. At that point, the undercover officer also re-entered.
"Mr. Allen stated that he then left his stall and knocked on officer Kavanaugh's stall and asked if he was alright," the affidavit reads. "Mr. Allen told me that Officer Kavanaugh said, "Yes, what are you up to?" Mr. Allen replied, 'This is a public place' and 'This ain't safe.' Mr. Allen then said that office Kavanaugh said, 'What do you have in mind?' and then mentioned 'twenty dollars.'"
You can read the rest here: page 1 / page 2. Another notable detail is Allen's claim that he asked the officer to get in the car with him and offered to perform oral sex because he feared he was going to be robbed. Allen said he wanted to reach a guard shack at the nearby Space Center.
Allen, who is due in court Thursday, is seeking to have the conversation with Lau thrown out, arguing that he was recorded without knowledge.

Two options.
Option A: Allen was trolling for gay sex in a park bathroom, and upon being arrested by the police created a series of fantastical stories to excuse or explain his behavior and save his career.
Option B: Allen showed incredibly poor judgment in thinking that the best way to escape a potential robbery is to offer pay $20 to perform a gay sex act on his attacker.
Regardless of what the jury finds, would you vote for Bob Allen, again, for anything?

Of course not. His campaign days are over, even if he doesnt believe they are in his all so twisted mind.
However, he will get out of this because of poor police work, then continue in the Legislature as a huge embarassment to Rubio, Sansom, Greer and even Crist. He may even be an anchor around some candidate's necks, given the potential really bad environment for Republicans in 2008. Think he might show up in some mail the Democrats would use?
"VOTE NO ON THE (insert candidate name)-BOB ALLEN TEAM" with nice accompanying pictures.
"WHEN BOB ALLEN WAS ARRESTED FOR SOLICITING SEX WITH A POLICE OFFICER, (insert candidate name) DID NOTHING. HOW CAN WE TRUST (insert candidate name) TO REPRESENT OUR FAMILY?"

Rep. Allen feared for his very life and in those tense moments of Republican angst decided to seek refuge in a public restroom in a public park to avoid scary stocky black men. Of course, as any of us would, he found comfort in gay sex and prostitution. Seems perfectly reasonable. To bad Angelo Capelli (with his Ivy League law experience) can not be on the legal team. Maybe former Rep. Mcinvale can help with fundraising for "Team Allen"...oops no that will not work either. Man.....these family values types are in all sort of trouble these days. Of course Bob Allen could have said he was simply researching his legislation increasing the penalty for sex in public places. "The Bob Allen Public Restroom Act" has all sort of new meanings now. Maybe they'll rename the park restrooms there after him!

This guy's an idiot. He didn't even have the sense to keep his mouth closed - I mean back at the station. He just blabbed, conversationally, first about building the park and then he just told the police all about what he says hapenned. Which is pretty incredible. And all the more incriminating for being soooo incredible.
No Miranda rights. none needed, he talked spontaneously with no prompting.
They don't really put you in jail just for a BJ. But they should, in this case for sheer stupidity.

Come on guys, think about it, what is so criminal about a white guy offering a black guy $20 to polish his nob? Both are consenting adults. I find the act itself disgusting but people pay for many different kinds of sex in many different ways every day. To response to this case is gotcha politics at its very worst. Lighten up - what he did was weird and distasteful - but not sufficient to destroy his life and family. Save your spleen for the legislators and the crooked lobbyists who sell out the interests of Florida citizens every day of every session.

well, he's got a case - the cop initially offered the $20, and if allen thought he was going to be mugged, and if allen was trying to lure him "over the bridge" as he said repeatedly, if i was on the jury i could start leaning toward reasonable doubt.
even according to the police statement the undercover had to slow allen down from walking away - allen's actions and statements as to his state of mind do seem to correlate.
it all still sounds extremely fishy, but, allen's got a case here.
to me - his version of the story is as almost as plausible as the undercover's version.

certainly sounds like the cops didn't do this exactly by the book.
bigger question is the political one - his judgement.
if you think you're going to be mugged - by a big stocky black guy (or a skinny white guy, for that matter)...it's pretty sick that of the following choices:
1) Run
2) Give him the money / take your beating / fight back
or
3) offer to give the guy a little head PLUS your $20
you choose number 3 ???

all his caliam do nothing towards explaining away any elements of the crime he's charged with. Here is a small legal lesson and what the judge will hear (midemenors don't get juries for 1):
1. undercover cops see man acting strange in a public place
2. Cops decide they need to look into this person acting strage in a park
3. Cop goes into bathroom twice, both times running into allen
4. during second encounter, allen approches cop in conversation in bathroom
5. coversation results in offer and acceptance of bj for $20
case closed. all the other crap is meaningless. Allen is saying he did exactly what they say he did, but has an excuse for it. that's far different from "i didn't do it".

I would agree that what he did isn't the worst thing ever. The reason police are cracking down on this type of thing has less to do with the behavior, but more to do with the place. He did this in a PUBLIC PARK. If you have kids, I am certain you wouldn't want you boy to walk into a PUBLIC BATHROOM and see two consenting adults engaing in this type of activity or having Allen's offer made to them.
