Rubio v. Crist delayed
You'll have to wait a bit longer for the legal showdown between Gov. Charlie Crist and House Speaker Marco Rubio over the gambling compact with the Seminole Tribe. The Florida Supreme Court today moved oral arguments to Jan. 30 from Dec. 12.
Rubio spokeswoman Jill Chamberlin sought to dispel any talk that the schedule change was a defeat for Rubio. "Moving the date for oral arguments to January gives the court time to review deliberately this important case," she said. "The date change has no bearing on how the court will resolve the case. Regardless of what the Dept. of Interior does, our state Supreme Court has the ultimate authority to determine whether the governor validly bound the State to the compact."

I like the sound of it!

So, why did the court postpone the oral arguments?

I am so glad to hear that the House of Representatives believes that the state court system actually has a role under the constitution. I didn't hear much of that when the voucher lawsuit was lost.
When the lawsuit proving that the FSE is unconstitutional and/or that the legislature is failing (or certainly will be failing) to meet the requirements for a high quality system of public education that they are similarly complementary of the court's role in our democracy.

Those of you who happily post the "Crist vs. Rubio" nonsense - believing it gives Crist the upper hand - what do you expect Crist to do when the Courts rule in favor of the House's position?

I would suspect that the compact would then be submitted to the Legislature for their "approval" or rejection. They would have to face the fact that if there is no compact that the US Dept of Interior will give the Indians the very same gambling without any funding coming to the state. So, I would enjoy watching that debate.
