Judge approves Fischetti examination

The bankruptcy judge gave the OK to creditors who want to quiz Robert Fischetti and require him to turn over documents. The examination is supposed to take place Sept. 18.

Comments

Fischetti if smart, will plea with what he knows. If he fights and obstructs, he is toast.

Two more weeks of freedom for Fiscetti. Then the hammer comes down.

Helen you used the word "quiz." Um, I think the lawyers will not be so gentle.

Pearlman said he hates depositions, because attorneys can be very aggressive in them, even shouting at him.

"Mr. Fiscetti, are you concerned that something you say at this deposition could implicate Mr. Pearlman?"

"No, not exactly."

"Thank you for bringing the documents the Court asked you to bring. I can see Mr. Pearlman won't be too happy about this evidence."

Yeah. Poor "pockets full of cash" "public defended" jet-setting, vacationing in Bali Lou.

Leaving the destitute billionaire alone to mentally count his stolen booty sounds like a great idea. NOT!

Any previous litigation by the state would have been a waste of time. Pearlman didn't have the money to satisfy any judgments then, did he, any more than he has now?!

What's the name of Fiscetti's attorney?

It's amazing how many posts here attacking FXT use the same grammar and phrases as other Difrawi posts.

I wonder how Ayman's campaign for congress is going, his we site seems to be down.

So do we really think that Fischetti is going to turn over anything, because more than likely it would incriminate him as well.

FXT,

What's your deal? Your previous post included vulgarities and now you put the person's name out for all to see. Why all the vindictiveness? I don't know or care who this guy is. If he committed a crime, was charged and paid hid debt to society for his misdeed, there is no need to harass him.

FXT,

Gee, that was real helpful. Stuff we don't want to see replaced with stuff we've already seen. Who are you trying to impress?

To All:
I apologize for the single reference to Omar Ghaffar, who was charged and convicted of lewd acts in a strip club. The issue, however, is on point because it illustrates the sleaziness of the legal counsel obtained by Pearlman and his confederates. One of the reasons why people get ripped off is they don't do their homework.

Any good investor knows that you need to do a thorough background investigation on the company and its chief executives to determine how sound the investment is. If there are significant bits of derrogatory information in that "jacket," it is a risky investment.

Excellent questions and great points.
I recommend a good place to keep up on the case is the Wikipedia site which is being updated with documents and reference material to help you keep this all straight.

The date appears to have passed without compliance, however, often there is communication between attorneys and the judge which takes some time to make it to the public record. If I can get some information I will let you know. In the meantime, I am sure Helen will let us know as soon as she learns.

In the bankruptcy matter, the US Trustee is Felicia S. Turner, who appointed Soneet Kapila to act as trustee. These motions were filed by his attorneys.

There are other matters which will be getting more attention and includes many more people.

who cares about the modeling / TCT / Options Talent scandal? HOW ABOUT NO ONE!

How is it that every blog entry gets turned into somed discussion about the talent era. I think this is working wonders for Pearlman Fischetti and all the other cronies. Nothing of real value is ever discussed.

If you want to really get Rene and Fisch and Pearlman in trouble just stay on topic.

I for one believe that Bob is a good guy and innocent. I don't believe he has any documents or information that is going to lead to anything other than a cleaned out bank account by Lou.

Its amazing the greatest con man in Florida History is the same 300 pound man that created NSYNC and the Backstreet Boys. I mean you have to give the guy some credit this whole thing is impressive. Who would have thought he was smart enough to fool CEO's, Banks, lawyers, accountants, and government officials. I new the guy could sell anything, but this is just crazy.

FXT

Why do you continue airing out you laundry here? Nobody cares about your current or previous problems. If you have pertinent information about this case, fine post it, but please keep the vulgarities to yourself. Just because something is a matter of public record doesn't mean people want to hear about it.

> For his sake, Fisch better not be using Reca Rene as his personal attorney.

Does Reca Rene have an attorney? Sounds like she needs one. She's already made some very bad legal decisions in this case...

Does anyone know the deadline the judge set for her to respond to his court order? Helen?

So we got to see who out lawyers who rather than anything resembling justice. Hey, great system if you have the money.

C'mon Francis, must you keep dragging all of us into your filth? Start your own blog where you can lobby at will. You can call it the "Vendetta Venue."

For his sake, Fisch better not be using Reca Rene as his personal attorney. Her mandate is to protect Tolner, Pearlman and Defrawy, in that order. It would be a conflict of interest for her to represent Fisch, too; however, that is an ethical issue, not a statute, but that has never stopped her in the past.

I have plenty of information and documentation on her dealings, and I have shared that informaiton liberally. Much of it is already available on the Internet. She was initially involved in the lawsuit Pearlman filed against me, but she was very quickly over her head and brought in Michael Joel Zwebner's attorney, Robert H. Cooper, and his genital-biting assistant (matter of public record).

FXT:

Do you think Chamberlain told Fiscetti not to hand over documents? She was told to hand them over, and if the attorney doesn't, should we expect him to?

What do you think will happen to her? Do you think she has documents that will incriminate Fiscetti? Or that he has stuff that will incriminate her?

How do you imagine the judge will deal with them? It seems as if he's not going to tolerate any nonsense and be played for a fool.

Do you have any inside info on Reca's past dealings for Pearlman that were borderline ethical/illegal? Who if anyone was the attorney of record on EISA/investment-related legal matters?

To 8:52 PM
The Fifth Amendment is invoked to protect against self-incrimination only, not to protect someone else. The remedy is a motion to compel and the judge has the ability to impose sanctions. If counsel for the trustee has evidence and reason to believe Fisch is obstructing, the judge can throw him in jail until he agrees to comply.

Fisch may actually provide information that shows that other individuals have not cooperated could create interesting twists.

To 9:15 PM
Fisch's lawyer will encourage him to sing. I would love to be a fly on the wall when Pearlman's attorneys talk to Fisch's attorney.

Is he a risk to flee?

Great legal system, teeth of a goldfish, when it should be a shark. Embarassing!!!!!!!

Absolutely. Fischetti's lawyers are going to make sure he says nothing.

Fischetti subpoena'd by bankruptcy trustee, pleads 5th, provides no documents, offers nothing. Banks subpoena Fischetti, expect more of the same.
